Little Swimmers NYC ("we," "us," or "our") provides private and semi-private swimming instruction for infants, children, and adults at client-provided pools throughout New York City. By booking a lesson or using our website, you ("you" or "client") agree to these Terms of Service.

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

Consent: By providing your mobile phone number and booking a lesson, you expressly consent to receive automated SMS text messages from Little Swimmers NYC. Consent is not a condition of purchase.

Message types: We may send appointment reminders, confirmations, schedule changes, and service-related communications via SMS.

Message frequency: Message frequency varies. You may receive multiple messages per week depending on your lesson schedule.

Message and data rates: Standard message and data rates may apply. You are responsible for any charges imposed by your mobile carrier.

Opt-out (STOP): You may cancel SMS notifications at any time by replying STOP to any text message from us. After sending STOP, you will receive one final confirmation message. No further SMS messages will be sent unless you re-subscribe.

Re-subscribe (START): To resume receiving SMS messages after opting out, reply START to any prior message from us or contact us directly.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

By using our services, you agree to:

• Provide accurate and current contact information, including a valid phone number and pool address.
• Ensure the pool meets minimum safety requirements: properly cleaned, chemically balanced, and at least 3.5 feet deep.
• Provide adult supervision for children at all times around water, outside of lesson instruction time.
• For infants and children under 18 months, a parent or trusted adult must be in the water during lessons.
• Provide reasonable notice for cancellations per our Cancellation Policy at littleswimmers.nyc/policy.
• Make timely payment for services as described in our Payment Policy.
• Not share your login credentials or account access with unauthorized persons.

To the fullest extent permitted by applicable law, Little Swimmers NYC and its instructors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or inability to use our services.

Our total liability to you for any direct damages shall not exceed the amount you paid for the specific lesson or service giving rise to the claim.

Little Swimmers NYC is not responsible for accidents or injuries arising from failure to follow instructor guidance, unsafe pool conditions provided by the client, or use of the pool outside of scheduled lesson time.

You agree to indemnify, defend, and hold harmless Little Swimmers NYC from any claims, losses, or damages arising from your breach of these Terms or misuse of our services.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of these courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
